1. Marketplace, not seller
Cars Mantra operates an online marketplace for pre-owned vehicles. We are not the owner, seller, dealer, financier, insurer or warranty-provider for any vehicle listed on the Platform. Listings are submitted by Sellers via the website, WhatsApp, Telegram or other channels and reflect information supplied by the Seller. While we moderate listings for obvious red flags, moderation does not amount to certification of the vehicle’s condition, documents, ownership or value.
2. No warranties
The Platform, listings, valuations, comparisons, EMI / loan estimators, and any AI-assisted content (including chatbot responses) are provided on an "as-is" and "as-available" basis without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, or freedom from error or virus. Valuations and EMI figures are indicative only and are not a binding offer from Cars Mantra or any lender.
3. Buyer must verify
Before paying any amount for a vehicle, the Buyer must independently inspect the vehicle, verify its identification (chassis / engine numbers, RC, insurance, NOC, hypothecation, PUC), confirm pending challans, and obtain professional advice if needed. Cars Mantra is not responsible for any misrepresentation, latent defect, undisclosed encumbrance, tampered odometer or fraudulent document supplied by a Seller.
4. Third-party content and links
The Platform may contain links to or content from third parties (for example, financing partners, insurance aggregators, vehicle-history reports, payment gateways, WhatsApp, Telegram). Cars Mantra does not control such third parties and is not responsible for their content, accuracy, performance, security or privacy practices.
5. Limitation of liability
To the maximum extent permitted by Indian law:
- Cars Mantra (including its directors, employees, contractors and partners) shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, including loss of profit, loss of goodwill, loss of data, business interruption, or loss arising from inability to use the Platform;
- Cars Mantra’s aggregate liability, whether in contract, tort, statute or otherwise, arising out of or in connection with the Platform, shall not exceed the fees you have actually paid to Cars Mantra in the twelve (12) months preceding the event, or INR 5,000, whichever is lower;
- Cars Mantra is not liable for any loss arising from a transaction between Seller and Buyer, including non-payment, non-delivery, fraud, undisclosed accident history, finance defaults, RC transfer delays, or post-sale disputes.
Nothing in this Disclaimer excludes any liability that cannot lawfully be excluded under Indian law.
6. Force majeure
Cars Mantra is not liable for any failure or delay caused by events beyond its reasonable control, including acts of God, fire, flood, pandemic, government action, internet or telecom outages, hosting provider outages, or strikes.
7. Reporting issues
If you believe a listing is inaccurate, misleading or unlawful, please contact us via our Grievance Redressal Policy. We will investigate promptly.
