These Terms of Service ("Terms") form a binding agreement between you ("User", "you") and Cars Mantra ("Cars Mantra", "we", "us", "our"), a business operating an online automotive marketplace from Gurgaon, Haryana, India. By accessing or using the Cars Mantra website, WhatsApp channel, Telegram channel, or any related service (collectively, the "Platform"), you agree to these Terms, our Privacy Policy, Cookie Policy, Seller Consent & Listing Agreement, Disclaimer and Grievance Redressal Policy. If you do not agree, do not use the Platform.
1. Nature of the Platform — marketplace only
Cars Mantra is an intermediary within the meaning of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. The Platform connects owners of pre-owned vehicles ("Sellers") with prospective buyers ("Buyers"). Cars Mantra is not the owner, seller, agent or guarantor of any vehicle listed on the Platform. We do not take title to vehicles, do not warrant their condition, and are not a party to any sale, exchange, financing or other transaction between a Seller and a Buyer. All transactions happen directly between Seller and Buyer.
2. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. You confirm that the information you provide is true, current and complete, and that your use of the Platform does not violate any law applicable to you.
3. Account, registration and submissions
- You may create an account on the website, or submit a vehicle for sale via our WhatsApp number or Telegram channel.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You agree that submissions via WhatsApp, Telegram and similar channels are treated as listings governed by these Terms and our Seller Consent & Listing Agreement.
4. Listings, moderation and removal
Every listing — whether submitted through the website, WhatsApp, Telegram or any other channel — is treated as a draft and goes live only after our moderation team approves it. We reserve the right, at our sole discretion and without prior notice, to:
- edit, reformat, re-photograph or summarise listing content for clarity and consistency;
- delay, reject, suspend, unpublish or permanently remove any listing or account;
- ask for additional documents (RC, insurance, photo ID) before publishing or after publishing;
- refuse to deal with any User where we have reason to believe content is false, fraudulent, duplicate, infringing, stolen, or otherwise non-compliant.
Moderation decisions are commercial judgements and do not amount to an endorsement of any vehicle that we do approve.
5. Buyer use of the Platform
Buyer-facing information (price, kilometres, photos, history) is supplied by the Seller. Buyers must independently inspect the vehicle, verify documents (RC, insurance, NOC, hypothecation), and conduct their own due diligence before paying any amount. Cars Mantra may, as a courtesy, help facilitate inspection or paperwork; this does not make us a party to the transaction.
6. Fees
Browsing the Platform is free. Specific value-added services (for example, premium placement, contact unlocks, or inspection visits) may be priced separately and will be clearly disclosed before you pay. Payments are processed by our payment partner; by transacting you also accept their terms. Refunds, where applicable, are governed by the specific service page and our Grievance Redressal Policy.
7. Prohibited use
- No scraping, mirroring, or automated submission outside our published interfaces.
- No listings for vehicles you do not lawfully own or are not authorised to sell.
- No misrepresentation of vehicle condition, ownership, accident history or documents.
- No posting of others’ personal data, no abusive content, no infringement of third-party intellectual property.
- No use of the Platform for money laundering, fraud, or any purpose prohibited by Indian law.
8. Intellectual property
The Cars Mantra name, logo, design, copy and Platform code are owned by us. By submitting photos and details of a vehicle you grant Cars Mantra a worldwide, royalty-free, non-exclusive licence to host, reproduce, watermark, edit, adapt, translate and publicly display that content for the purpose of marketing your vehicle and operating the Platform, for the duration of the listing and a reasonable archival period thereafter.
9. Disclaimers and limitation of liability
The Platform and all listings are provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Cars Mantra disclaims all warranties (express or implied) including merchantability, fitness for purpose, and non-infringement. Cars Mantra’s aggregate liability in connection with the Platform is capped at the fees, if any, that you have actually paid to Cars Mantra in the twelve (12) months preceding the event giving rise to the claim, or INR 5,000, whichever is lower.
10. Indemnity
You agree to defend, indemnify and hold harmless Cars Mantra, its officers, employees and partners from any claim, loss, liability or expense (including legal fees) arising out of your breach of these Terms, your listings, your transactions with other Users, or your violation of any law or third-party right.
11. Suspension and termination
We may suspend or terminate your access to the Platform, with or without notice, if we believe you have breached these Terms, applicable law, or if continued access poses a risk to other Users. You may stop using the Platform at any time; deletion of your account does not extinguish obligations or liabilities that have already accrued.
12. Changes to the Terms
We may revise these Terms from time to time. Material changes will be notified via the website or on your registered contact. Continued use of the Platform after the effective date constitutes acceptance.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to the grievance procedure, the courts at Gurugram, Haryana shall have exclusive jurisdiction over any dispute arising out of or in connection with the Platform.
